Both Maryland and D.C. use child support Guideline calculators (i.e. formulaic calculations) that rely on a number of factors to calculate child support, including each parent’s income from all sources and the number of overnights the child/children enjoy with each parent. Families whose combined annual income exceeds the Guideline threshold (i.e. above Guideline cases) enjoy less clarity as far as outcomes. In those instances, the Court relies on a subjective, “needs based” analysis that varies with the income level of the family.
Whether it’s a Guideline case or an “above Guideline” case, Erik assists clients in navigating every aspect of the calculation process, including discovery related to forms and amounts of income, complex income calculations (e.g. including imputed income in the case of voluntary impoverishment, self-employment earnings, fluctuating or bonus-based compensation, executive compensation), modeling “needs” in above Guideline cases, and advocating for outcomes grounded in data.
Erik also regularly handle arrearage enforcement and/or contempt actions and interstate issues under the Uniform Interstate Family Support Act (UIFSA).
